Derativa potestas non potest esse major primitiva. The power which is derived1 cannot be greater than that from which it is derived.

Derogatur legi, cum pars2 detrahitur; abrogatur legi, cum prorsus tollitur. To derogate4 from a law is to enact5 something contrary to it; to abrogate6 a law, is to abolish it entirely7. Dig. 50, 16, 102. See 1 Bouv. Inst. n. 91.

Dolus auctoris non nocet successori. The fraud of a possessor does not prejudice the successor.
