各国家级经济技术开发区，厦门海沧投资区、上海金桥出口加工区、海南洋浦经济开发区、宁波大榭开发区、苏州工业园区管委会：

　　为贯彻全国国家级经济技术开发区工作会议精神，落实《国务院办公厅转发商务部等部门关于促进国家级经济技术开发区进一步提高发展水平若干意见的通知》（国办发（2005）15号，以下简称《若干意见》），现将商务部、国土资源部、建设部关于《国家级经济技术开发区扩建审批原则和审批程序》印发各区。国家级经济技术开发区扩建请按此执行。

　　国家级经济技术开发区扩建报送的材料还需增加国家级经济技术开发区管理体制、机构设置、主要职责、人员编制的情况及批准文件。

国家级经济技术开发区扩建审批原则和审批程序

　　为落实国务院办公厅《关于暂停审批各类开发区的紧急通知》（国办发明电（2003）30号）关于"国家级开发区确需扩建的须报国务院审批"的规定，促进国家级经济技术开发区（以下简称国家级开发区）持续、快速、健康发展，现对国家级开发区扩建提出以下审批原则和审批程序：

　　一、审批原则

　　（一）对已完成原经国务院批准规划面积的开发建设，因经济发展需求确需扩大规划用地范围的国家级开发区可申请扩建。

　　（二）扩建国家级开发区必须符合所在城市的土地利用总体规划和城市总体规划，土地管理与规划管理工作应符合国家有关规定。

　　（三）申请扩建应切合开发区经济发展的实际情况，不占用或少占用耕地，根据规划确需占用的，要依法办理农用地转用和土地征用相关手续，并妥善安排好失地农民的工作与生活。

　　（四）申请扩建国家级开发区应符合以下条件之一：

　　1、主要经济指标在申报前两年保持持续增长，综合投资环境评价总指数排名在25位之前；

　　2、年工业产值40亿元/平方公里以上；

　　3、年税收收入达到10亿元；

　　4、年出口额达到5亿美元；

　　5、实际吸收外商直接投资累计10亿美元。

　　二、审批程序

　　（一）由国家级开发区所在省、自治区、直辖市人民政府正式向国务院行文提出扩建申请。

　　（二）由国务院批转国家级经济技术开发区主管部门（商务部）会同国土资源部、建设部提出初审意见。

　　（三）在商务部、国土资源部、建设部三部门初审意见一致的基础上，由商务部起草请示报告会签国土资源部、建设部后报国务院审批。

　　（四）经国务院批准，由商务部、国土资源部、建设部三部门联合发函予以批复。

　　三、需报送的文件、资料

　　（一）国家级开发区综合经济发展情况。（国家级开发区管理委员会或相应管理机构出具）；

　　（二）国家级开发区土地利用规划和城市规划与工业、仓储、房地产等各类规划用地面积与比例、开发区批准文件和文本、说明书、图纸等。（国家级开发区管理委员会或相应管理机构和所在城市国土资源管理部门、城市规划管理部门共同出具）；

　　（三）国家级开发区依法用地的证明文件。（省级国土资源管理部门出具）；

　　（四）国家级开发区依法实施城市规划管理的证明文件。（由省级城市规划管理部门出具）；

　　（五）经国务院批准或省级人民政府批准的所在城市土地利用总体规划和城市总体规划图纸及文本，在图纸上需标出国家级开发区现有位置，拟扩建区域位置，明确的四至边界。（加盖省级国土资源管理部门的公章及省级城市规划管理部门公章）。

　　（六）国家级开发区区域经济社会发展总体规划和实施情况。

Circular of the General Office of the Ministry¹ of Commerce of the People's Republic of China, on Printing and Issuing the Principles and Procedures for Examining and Approving the Expansion of State Economic and Technological² Development Zone

All the State Economic and Technological Development Zones, management committee of Xiamen Haicang Investment Zone, Shanghai Jinqiao Export Processing Zone, Hainan Yangpu Economic Development Zone, Ningbo Daxie Development Zone and Suzhou Industrial Zone:

　　In order to implement³ the spirit of Expansion of State Economic and Technological Development Zone working conference and carry out the Circular on Suggestions on Further Improving the Development Level State Economic and Technological Development Zone （hereinafter referred to as Suggestions）, Principles and Procedures for Examining and Approving the Expansion of State Economic and Technological Development Zone is now printed and issued to all the above-mentioned zones, according to which the expansion of State Economic and Technological Development Zone shall be implemented⁴.

　　The materials submitted by State Economic and Technological Development Zone shall also include the Management System, Organization Chart, Main Responsibility, Authorized⁵ Size of Staff and Approval Document of State Economic and Technological Development Zone.
