  第一条 (目的和依据)

  为加强长江口中华鲟自然保护区的管理,保护中华鲟及其赖以栖息生存的自然生态环境和自然资源,根据有关法律和《中华人民共和国自然保护区条例》等法规,制定本办法。

  第二条 (保护区性质和范围)

  位于崇明岛东滩的长江口中华鲟自然保护区(以下简称保护区)是经市政府确定,以中华鲟及其赖以栖息生存的自然生态环境为主要保护对象的特殊区域。

  保护区北起八滧港,南起奚家港,由崇明岛东滩已围垦的外围大堤与吴淞标高负5米的等深线围成。

  第三条 (管理机构)

  上海市农业委员会(以下简称市农委)会同崇明县政府负责保护区规划的编制、保护区的建设及相关管理活动。市农委所属的上海市长江口中华鲟自然保护区管理处(以下简称保护区管理处)负责保护区的日常管理。

  上海市环境保护局(以下简称市环保局)负责对保护区的环境保护实施指导和监督。

  本市海洋、水务、交通、公安和海事等有关部门按照各自的职责,协同做好保护区的管理工作。

  第四条 (保护区范围的调整及其程序)

  保护区的范围可以根据滩涂淤涨、中华鲟分布和活动情况的变化,进行必要的调整。

  保护区范围的调整由市农委会同崇明县政府及相关行政管理部门提出方案,经自然保护区评审委员会评审后,由市环保局进行综合平衡,提出审核建议,上报市政府批准并予以公布。

  第五条 (界标的设置)

  保护区管理处应当按照市政府批准并公布的保护区范围,在保护区边界的显著位置设置区域界标。

  第六条 (封区管理期)

  在每年5月1日至9月30日的中华鲟幼鱼集中活动期间,保护区实施封区管理。封区期间,禁止从事渔业等生产经营活动。

  第七条 (非封区管理期)

  非封区管理期间,渔民进入保护区从事渔业生产活动的,应当依法办理捕捞许可证。

  第八条 (禁止行为)

  禁止任何单位和个人在保护区内从事下列活动:

  (一)破坏、损毁或者擅自移动保护区界标和保护设施;

  (二)排放、倾倒或者弃置污染物;

  (三)采用投毒、爆炸或者电捕等方式采捕水生动植物;

  (四)搭建、爆破、钻探;

  (五)挖泥、烧荒、开垦;

  (六)其他影响中华鲟栖息生存环境的活动。

  第九条 (科研活动的申请和审批)

  因教学实验和标本采集等需进入保护区从事有关科学研究活动的,应当向保护区管理处提交书面申请;境外组织或者个人进入保护区从事科学研究、教学实验和标本采集活动的,应当向市农委提交书面申请。

  书面申请应当包括以下内容:

  (一)申请人的基本情况;

  (二)进入保护区实施的具体项目和主要目的;

  (三)预定活动的时间、内容、规模、人数、范围以及使用的相关设备等。

  市农委或者保护区管理处应当自受理申请之日起20个工作日内,作出审批决定。经审批同意的发给《保护区通行证》;不同意的应当书面说明理由。

  进入保护区从事科学研究等活动需捕捉中华鲟或者采集中华鲟鱼类标本的,经受理申请的部门审核,并向国务院渔业行政主管部门申请特许捕捉证后,方可从事相关活动。

  第十条 (进入人员的总量控制)

  保护区管理处应当会同崇明县政府以及渔政等相关管理部门,制定对封区和非封区管理期进入保护区从事科学研究等活动人员的总量控制计划。

  第十一条 (紧急情况下的进入)

  因防汛抗灾、灾害性天气影响等紧急情况进入保护区的,应当遵守保护区的各项规定,并向保护区管理处通报;相关情形消除后,应当立即退出保护区。

  第十二条 (突发事件处理)

  因发生事故或者其它突发性事件,造成或者可能造成保护区污染或者其他破坏的,有关单位或者个人应当立即采取措施,并及时向保护区管理处和当地环境保护部门报告,接受调查处理。

  第十三条 (外围作业的控制)

  在保护区周边进行重大建设工程的,作业单位应当事先与保护区管理处协商,经专家论证可能对保护区内的自然资源及其生态环境产生影响的,作业单位应当采取有效控制措施。

  第十四条 (误捕放生)

  渔民在捕捞作业时误捕中华鲟及其他珍贵、濒危水生野生动物的,应当立即无条件放生。

  第十五条 (应急处置)

  任何单位和个人发现受伤、搁浅或者因误入港湾、河汊而被困的中华鲟及其他珍贵、濒危水生野生动物的,应当采取应急救护措施,并及时报告保护区管理处;发现中华鲟及其他珍贵、濒危水生野生动物已经死亡的,应当交由保护区管理处妥善处理。

  因保护、抢救中华鲟及其他珍贵、濒危水生野生动物发生财产损失的,可以向保护区管理处申请补偿;经调查情况属实的,由保护区管理处按照有关规定和标准,给予适当补偿。

  第十六条 (救护处置)

  保护区管理处应当建造暂养救护设施,并配备必要的救护人员,负责伤病中华鲟的救护、医治等。

  第十七条 (繁殖及增殖)

  保护区管理处应当协助有关部门开展中华鲟的科学研究,组织实施中华鲟的人工繁殖和增殖放流。

  第十八条 (资源调查和环境监测)

  保护区管理处应当在保护区内开展中华鲟自然资源调查和环境监测,定期对中华鲟的活动规律、种群数量和行为习性进行巡视。

  第十九条 (经费)

  保护区的保护经费主要来源于以下渠道:

  (一)财政专项拨款;

  (二)国内外组织或者个人捐赠;

  (三)法律允许的其他筹集方式。

  第二十条 (表彰和奖励)

  市农委对在保护区的建设、管理和有关的科学研究工作中做出显著成绩的单位和个人,应当给予表彰或者奖励。

  第二十一条 (行政处罚)

  封区期间进入保护区从事捕捞等生产活动的,由保护区管理处责令改正,并根据不同情节处以300元以上1万元以下的罚款。

  擅自移动或者破坏保护区界标的,由保护区管理处责令恢复原状或者赔偿损失,并可以根据不同情节处以100元以上5000元以下的罚款。

  在保护区进行挖泥、烧荒、开垦等活动的,由保护区管理处责令恢复原状或者采取其他补救措施,并可以根据不同情节处以300元以上1万元以下的罚款。

  在保护区进行搭建、爆破、钻探等活动的,由保护区管理处责令恢复原状或者采取其他补救措施,并可以根据不同情节处以200元以上2万元以下的罚款。

  未经批准擅自进入保护区从事科学研究等活动的,由保护区管理处责令改正,并可以根据不同情节处以100元以上5000元以下的罚款。

  违反本办法规定,给中华鲟保护和保护区的生态环境造成损失的,由市农委责令当事人依法予以赔偿;有违法所得的,没收违法所得。

  第二十二条 (相关部门实施的处罚)

  在保护区内采用投毒、爆炸方式进行捕捞,在保护区内排放、倾倒、弃置污染物,或者捕杀国家重点保护水生野生动物的,由环保、渔业等行政主管部门按照相关法律、法规的规定予以处罚。

  对违反本办法,情节严重构成犯罪的,依法追究刑事责任。

  第二十三条 (救济途径)

  当事人对市农委或者保护区管理处作出的具体行政行为不服的,可以依照《中华人民共和国行政复议法》或者《中华人民共和国行政诉讼法》的规定,申请行政复议或者提起行政诉讼。

  第二十四条 (施行日期)

  本办法自2005年4月15日起施行。

Procedures of Shanghai Municipality on the Administration of the Chinese Paddlefish Natural Reserve at the Mouth of Yangtze RiverPromulgated on March 15, 2005 by Decree No. 48 of the Shanghai Municipal People's Government)

  Article 1 (Purpose and Basis)

  For the purpose of strengthening the administration of the Chinese Paddlefish Natural Reserve at the Mouth of Yangtze River, protecting the Chinese paddlefish and the natural ecological1 environment and natural resources on which the living and subsistence of the Chinese paddlefish hinge, these procedures are formulated2 on the basis of relevant laws and the “Regulations of the People's Republic of China on Natural Reserves”.

  Article 2 (Nature and Scope of Natural Reserve)

  The Chinese Paddlefish Natural Reserve at the Mouth of the Yangtze River which is situated3 at the Dongtan of the Chongming Island (hereinafter referred to as CPNR) is the special zone where the Chinese paddlefish and the natural ecological environment on which the living and subsistence of the Chinese paddlefish hinge are key objects of protection, determined4 by the Municipal People's Government.

  The CPNR, beginning in the North from the Bajiaogang and in the South from the Xijiagang, is enclosed with the Dongtan outer dyke5 built for reclaiming7 land from marsh8 and the isobath of Wusong heightmark of minus 5 meters.

  Article 3 (Administration Agency)

  The Shanghai Municipal Agriculture Commission (hereinafter referred to as SMAC) shall, jointly9 with the Chongming County People's Government, be responsible for the drawing-up of the planning of the CPNR, the construction of the CPNR and the related administrative10 activities. The Shanghai Municipal Administrative Office of the Chinese Paddlefish National Reserve at the Yangtze River Mouth (hereinafter referred to as the SMAOCPNR) is in charge of the routine management of the CPNR.

  The Shanghai Municipal Environmental Protection Bureau (hereinafter referred to as SMEPB) shall be responsible for the direction and supervision11 for carrying out the environmental protection of the CPNR.

  The relevant municipal departments of marine12, water affairs, communications, public security and maritime13 affairs, etc., shall coordinate14 in doing a good job of the administrative work of the CPNR in accordance with their respective functions and duties.

  Article 4 (Adjustment of the Limits of the CPNR and its Procedure)

  Necessary adjustment may be made in the limits of the CPNR according to the situations of the silting15 up of the mudflat, the distribution of Chinese paddlefish, and the change of their activities.

  For the adjustment of the limits of the CPNR, the scheme shall be put forward jointly by the SMAC, the Chongming County People's Government and the relevant administrative departments, and shall, after the examination and appraisal16 by the Appraisal Committee of the Natural Reserve, be comprehensively balanced by the Municipal Environmental Protection Bureau that shall put forward its comments on examination and verification and submit them to the Municipal Government for approval, and be publicized

  Article 5 (The Setting up of Boundary Marks)

  The SMAOCPNR shall set up boundary works at the conspicuous17 positions on the boundary of the CPNR according to the limits of the CPNR approved and publicized by the Municipal Government.

  Article 6 (Period of Management of Closed CPNR)

  During the period from May 1 to September 30 of every year, when the young paddlefish are active and gathering18, the CPNR carries out the management of the closed CPNR. In the period of management of closed CPNR, all production and operation activities of fishery are prohibited.

  Article 7 (Period of Management of Non-closed CPNR)

  During the period of management of non-closed CPNR, the fishermen who enter the CPNR to engage in fishery activities shall obtain for the Fishing Permit according to law.

  Article 8 (Prohibited Acts)

  All units and individual persons are prohibited to engage in any one of the following activities in the CPNR:

  1. To damage or destroy or move without authorization19 any boundary mark and protection facilities of the CPNR;

  2. To discharge, dump, cast away pollutants20;

  3. To collect or catch aquatic21 plants and animals through using poison, explosive, or giving electric shocks;

  4. To put up structures, demolish22, or drill;

  5. To excavate23 earth, reclaim6 farm land by burning wild grass and bushes, or bring barren land under cultivation24;

  6. Other activities that affect the environment of the living and subsistence of the Chinese paddlefish.

  Article 9 (Application for Examination and Approval of Scientific Research Activities)

  Anyone who enters the CPNR and conduct scientific research activities for the need of teaching experiment and collection of specimens25 shall submit to the SMAOCPNR an application in writing; any organization or individual person from abroad that wants to enter the CPNR to conduct scientific research, teaching experiment, and collection of specimens activities shall submit an application in writing to the SMAC.

  A written application shall cover the following contents:

  1. The basic information about the applicant26;

  2. The specific item to be performed in the CPNR and the main purpose of entering the CPNR;

  3. The time, contents, scale, number of persons, scope, and the relevant equipment to be used of the scheduled activities;

  The SMAC or the SMAOCPNR shall, within 20 working days from the day of accepting and handling the application, make the decision of examination and approval, and shall, after its approval, issue the “CPNR Pass” to the applicant; and shall give reasons in writing if it does not make the approval.

  Anyone that enters the CPNR to conduct scientific research activities and needs to catch Chinese paddlefish or collect specimens of Chinese paddlefish shall conduct the catching27 activities only after the examination and approval by the accepting and handling department, and the application to the competent administrative department of fishery of the State Council for “Special Permit to Catch”.

  Article 10 (Control of Total Number of Persons Entering the CPNR)

  The SMAOCPNR shall, jointly with the Chongming County People's Government and the relevant administrative departments such as fishery, etc. draw up the plan of controlling the total number of persons entering the CPNR to engage in scientific research activities during the period of management of closed and non-closed CPNR.

  Article 11 (Entry under Emergency)

  Those who enter the CPNR under such emergency condition as preventing seasonal28 flood, combating disasters and the effect of disastrous29 weather shall abide30 by all the provisions of the CPNR, and report the situation to the SMAOCPNR, and shall withdraw from the CPNR immediately when the situation concerned is eliminated.

  Article 12 (Handling of Contingencies31

  When accidents or other contingencies occur in the CPNR that cause or may possibly cause the pollution or other damages of the CPNR, the unit or individual person concerned shall immediately take measures, and report them timely to the local environmental protection department, and accept the investigation32 and handling.

  Article 13 (Control of Peripheral33 Operation)

  Where a major construction project is conducted in the periphery34 of the CPNR, the project construction unit shall consult in advance with the SMAOCPNR, if the demonstration35 of the experts proves that the project will affect the natural resources and the ecological environment, the project construction unit shall take effective controlling measures.

  Article 14 (Release upon Catching by Mistake)

  Any fisherman who catches a Chinese paddlefish or any other rare and endangered wild aquatic animal by mistake shall release them immediately and unconditionally36.

  Article 15 (Emergency Handling)

  Any unit or individual person that finds any Chinese paddlefish or other rare or endangered wild aquatic animal that is wounded, gets stranded37, or accidentally enters the harbor or the branch of a river and thus land itself in difficulty, shall take emergency rescue measures, and make a report timely to the SMAOCPNR; if any Chinese paddlefish and other rare or endangered wild aquatic animal is found dead, it shall be handed over to the SMAOCPNR to be handled properly.

  In case losses of property are incurred38 because of protecting and rescuing the Chinese paddlefish or other rare or endangered wild aquatic animal, the party concerned may apply to the SMAOCPNR for compensation, the SMAOCPNR shall grant appropriate compensation according to relevant provision after finding convincing reason upon investigation.

  Article 16 (Rescue and Treatment)

  The SMAOCPNR shall build a temporary foster and rescue center, and provide the necessary rescue personnel and take charge of the rescue, treatment and cure of the wounded or sick Chinese paddlefish.

  Article 17 (Breeding and Propagating)

  The SMAOCPNR shall assist the relevant departments to carry out the scientific research on Chinese paddlefish, and organize and carry out the artificial breeding, propagation, and release them into the river.

  Article 18 (Survey of Resource and Monitoring of Environment)

  The SMAOCPNR shall conduct in the CPNR the survey of the natural resources of the Chinese paddlefish and the monitoring of the environment, and make regular inspection39 of the law of activity, the number of population, and the way of life of the Chinese paddlefish.

  Article 19 (Funds)

  The protection funds of the CPNR mainly come from the following channels:

  1. Special appropriation40 of the finance;

  2. Donations from organizations or individual persons from at home and abroad;

  3. Other ways of fund-raising permitted by law.

  Article 20 (Commendation, Award and Encouragement)

  The SMAC shall commend, award and encourage the units and individual persons that have made significant achievements in the construction and management of the CPNR and their relevant work of scientific research.

  Article 21 (Administrative Punishment)

  For the act of entering the CPNR in the closed CPNR period and carrying out fishing activities, the SMAOCPNR shall order a correction, and may cumulatively41 impose a fine of between not less than 300 yuan and not more than 10000 yuan in accordance with the different circumstances.

  For the acts of moving or damaging without authorization any boundary mark, the SMAOCPNR shall order the wrongdoer to restore the status quo ante or compensate42 the losses, and may cumulatively impose a fine of between not less than 100 yuan and not more than 5000 yuan in accordance with the different circumstances.

  For the acts of excavating43 earth, reclaiming farm land by burning wild grass and bushes, or bringing barren land under cultivation in the CPNR, the SMAOCPNR shall order the wrongdoer to restore the status quo ante, or adopt other remedial measures, and may cumulatively impose a fine of between not less than 300 yuan and not more than 10000 yuan in accordance with the different circumstances.

  For the acts of putting up structures, demolishing44, and drilling in the CPNR, the SMAOCPNR shall order the wrongdoer to restore the status quo ante or adopt other remedial measures, and may cumulatively impose a fine of between not less than 200 yuan and not more than 20000 yuan in accordance with the different circumstances.

  For the acts of entering the CPNR to carry out scientific research without authorization, the SMAOCPNR shall order a correction, and may cumulatively impose a fine of between not less than 100 yuan and not more than 5000 yuan in accordance with the different circumstances.

  For the acts of violating the provisions of these Procedures, thus causing losses to the protection of the Chinese paddlefish or the eco-environment of the CPNR, the SMAC shall order the wrongdoers to make compensation in accordance with law; in case of illegal gains, the illegal gains shall be confisticated.

  Article 22 (Punishment Imposed by Relevant Departments)

  For the acts of fishing by means of poisoning, or explosion in the CPNR, or discharging, dumping, casting away pollutants in the CPNR, or catching and killing45 the wild aquatic animal mainly protected by the State, the competent administrative departments of environmental protection, and fishery shall, in accordance with the provisions of relevant laws and regulations, impose punishment.

  In case of serious cases that violate these Procedures and constitute a crime, the wrongdoer shall be prosecuted46 for criminal liabilities.

  Article 23 (Remedy)

  In case a party concerned does not accept the specific administrative act made by the SMAC or the SMAOCPNR, he/she/it may, according to the provisions of the “Law of the People's Republic of China on Administrative Reconsideration” or the “Administrative Litigation Law of the People's Republic of China”, apply for administrative reconsideration or lodge47 an administrative suit.

  Article 24 (Effective Date)

  These Procedures shall become effective on April 15, 2005
