有关化学品及相关设备和技术出口管制办法
(2002-10-18外经贸部、国家经贸委、海关总署) 第一条 为加强对有关化学品及相关设备和技术的出口管制,维护国家安全和社会公共利益,制定本办法。 第二条 本办法所称有关化学品及相关设备和技术的出口,是指本办法附件《有关化学品及相关设备和技术出口管制清单》(以下简称《管制清单》)所列的物项和技术的贸易性出口以及对外赠送、展览、科技合作、援助、服务和以其他方式进行的技术转移。 第三条 有关化学品及相关设备和技术的出口应当遵守国家的有关法律、行政法规和本办法的规定,不得损害国家安全和社会公共利益。 第四条 国家对有关化学品及相关设备和技术出口实行严格管理,防止《管制清单》所列物项和技术被用于化学武器目的。 第五条 国家对《管制清单》所列物项和技术的出口实行许可制度。未经许可,任何单位和个人不得出口《管制清单》所列物项和技术。 第六条 有关化学品及相关设备和技术出口的接受方应当保证,不将中国提供的有关化学品及相关设备和技术用于储存、加工、生产、处理化学武器或用于生产化学武器前体化学品;未经中国政府允许,不得将中国提供的有关化学品及相关设备和技术用于申明的最终用途以外的用途或者向申明的最终用户以外的第三方转让。 第七条 从事有关化学品及相关设备和技术出口的经营者,须经对外贸易经济合作部(以下简称外经贸部)登记。未经登记,任何单位或个人不得经营有关化学品及相关设备和技术出口。具体登记办法由外经贸部规定。 第八条 出口《管制清单》所列物项和技术,应当向外经贸部提出申请,填写有关化学品及相关设备和技术出口申请表(以下简称出口申请表),并提交下列文件: (一)出口经营者从事有关化学品及相关设备和技术出口的经营资格证明; (二)出口经营者的法定代表人、主要经营管理人以及经办人的身份证明; (三)合同或协议的副本; (四)有关化学品及相关设备和技术的技术说明; (五)最终用户和最终用途证明; (六)接受方依照本办法第六条规定提供的保证文书; (七)外经贸部要求提交的其他文件。 第九条 出口经营者应如实填写出口申请表,出口申请表由外经贸部统一印制。 第十条 外经贸部应当自收到出口申请表和本办法第八条规定的文件之日起进行审查,或会同国务院有关部门进行审查,并在45个工作日内作出许可或不许可的决定。 第十一条 对国家安全、社会公共利益或外交政策有重大影响的有关化学品及相关设备和技术出口,外经贸部应当会同有关部门报国务院批准。 报国务院批准的,不受本办法第十条规定时限的限制。 第十二条 有关化学品及相关设备和技术出口申请经审查许可的,由外经贸部颁发有关化学品及相关设备和技术出口许可证件(以下简称出口许可证件),并书面通知海关。 第十三条 出口许可证件持有人改变原申请出口的有关化学品及相关设备和技术的,应当交回原出口许可证件,并依照本办法的有关规定,重新申请出口许可证件。 第十四条 有关化学品及相关设备和技术出口时,出口经营者应当向海关出具出口许可证件,依照海关规定办理海关手续。 第十五条 接受方违反其依照本办法第六条规定做出的保证,或出现《管制清单》所规定的可被用于化学武器目的的有关化学品及相关设备和技术扩散危险时,外经贸部应当对已经颁发的出口许可证件予以中止或撤销,并书面通知海关。 第十六条 出口经营者知道或应当知道所出口的有关化学品及相关设备和技术将被接受方直接用于化学武器目的或化学武器前体化学品生产目的,无论该物项或技术是否列入《管制清单》,都不应当出口。 第十七条 经国务院批准,外经贸部会同国务院有关部门,可临时决定对《管制清单》以外的特定物项和技术的出口依照本办法实施管制。 前款规定的特定物项和技术的出口,应当依照本办法的规定经过许可。 第十八条 未经许可擅自出口有关化学品及相关设备和技术,或擅自超出许可范围出口有关化学品及相关设备和技术的,依照刑法关于走私罪、非法经营罪、泄露国家秘密罪或其他罪的规定,依法追究刑事责任;尚不够刑事处罚的,区别不同情况,依照海关法的有关规定处罚,或由外经贸部给予警告,处非法所得1倍以上5倍以下的罚款;外经贸部并可以撤销其对外贸易经营许可。 第十九条 伪造、变造、买卖或通过欺骗等其他不正当手段获取有关化学品及相关设备和技术出口许可证件,依照刑法关于非法经营罪或伪造、变造、买卖国家机关公文、证件、印章罪的规定,依法追究刑事责任;尚不够刑事处罚的,依照海关法的有关规定处罚;外经贸部并可以撤销其对外贸易经营许可。 第二十条 对有关化学品及相关设备和技术出口实施管制的国家工作人员,滥用职权、玩忽职守或利用职务上的便利收受、索取他人财物的,依照刑法关于滥用职权罪、玩忽职守罪、受贿罪或其他罪的规定,依法追究刑事责任;尚不够刑事处罚的,依法给予行政处分。 第二十一条 外经贸部可以会同国务院有关部门,根据实际情况对《管制清单》进行调整。 第二十二条 本办法自2002年11月19日起施行。 Measures on Export Control of Certain Chemicals And Related Equipment And Technologies Article 1 These Measures are formulated2 for the purpose of strengthening export control of certain chemicals and related equipment and technologies, and safeguarding the State security and social and public interests. Article 2 The export of certain chemicals and related equipment and technologies referred to in these Measures means the export for trade of items and technologies listed in the "Certain Chemicals and Related Equipment and Technologies Export Control List" (hereinafter referred to as the Control List) attached to these Measures, and the gift to, exhibition in, scientific and technological3 cooperation with, assistance to, provision of service for as such and other forms of technological transfer thereof to foreign countries and regions. Article 3 The export of certain chemicals and related equipment and technologies shall be in accordance with relevant laws and administrative4 regulations of the State and these Measures, and shall not imperil the State security and social and public interests. Article 4 The State shall exercise strict control on the export of certain chemicals and related equipment and technologies, so as to prevent the items and technologies listed in the Control List from being used for the purpose of chemical weapons. Article 5 The State shall practice a licensing5 system for the export of items and technologies listed in the Control List. Without being licensed6, no unit or individual shall export such items or technologies. Article 6 The receiving party of certain chemicals and related equipment and technologies shall guarantee not to use such chemicals and related equipment and technologies supplied by China in the storing, processing, producing and treating of chemical weapons or in the production of chemical weapons precursors8. Without the consent of the Chinese Government, the receiving party shall not use the chemicals and related equipment and technologies supplied by China for purposes other than the declared end-use, or transfer such chemicals and related equipment and technologies to any third party other than the declared end-user. Article 7 Exporters of certain chemicals and related equipment and technologies shall register themselves with the Ministry of Foreign Trade and Economic Cooperation (hereinafter referred to as MOFTEC). Without such registration10, no unit or individual shall export certain chemicals and related equipment and technologies. The specific measures for such registration shall be formulated by MOFTEC. Article 8 Anyone who intends to export items and technologies in the Control List shall apply to MOFTEC, fill in the export application form for certain chemicals and related equipment and technologies (hereinafter referred to as the export application form), and submit the following documents: 1. certificate of registration for the exporter to export certain chemicals and related equipment and technologies; 2. identifications of the applicant11''s legal representative, chief manager(s) and the person(s) handling the deal; 3. duplicates of the contract or agreement; 4. technical specifications12 of the certain chemicals and related equipment and technologies; 5. certificates of the end-user and end-use; 6. documents of guarantee as defined inArticle 6 of these Measures; 7. other documents as may be required by MOFTEC. Article 9 An applicant shall truthfully fill in the export application form. Export application forms shall be uniformly produced by MOFTEC. Article 10 MOFTEC shall, within 45 working days from the date of receipt of the export application form and the documents specified13 inArticle 8 of these Measures, examine, or jointly14 with other relevant departments of the State Council examine the application, and make a decision of approval or denial. Article 11 Where the export of certain chemicals and related equipment and technologies entails15 significant impact on the State security and social and public interests or foreign policy, MOFTEC shall, jointly with relevant departments, submit the case to the State Council for approval. Where the export of certain chemicals and related equipment and technologies is submitted to the State Council for approval, the timing16 restriction17 set forth18 inArticle 10 of these Measures shall not apply. Article 12 Where an application for the export of certain chemicals and related equipment and technologies is examined and approved, MOFTEC shall issue a license7 for the export of certain chemicals and related equipment and technologies (hereinafter referred to as an export license), and notify the Customs in writing. Article 13 An export license holder19 who intends to change the certain chemicals and related equipment and technologies originally applied20 for export shall return the original export license and file a new application to obtain a new export license according to relevant provisions of these Measures. Article 14 While exporting certain chemicals and related equipment and technologies, the exporter shall present the export license to the Customs and complete customs procedures in accordance with the provisions of the Customs. Article 15 Where the receiving party contravenes21 the guarantees made underArticle 6 of these Measures, or there is a risk of proliferation of certain chemicals and related equipment and technologies in the Control List for the purpose of chemical weapons, MOFTEC shall suspend or revoke22 the export license granted and notify the Customs in writing. Article 16 Where the exporter knows or should know that the certain chemicals and related equipment and technologies to be exported will be used by the receiving party directly for the purpose of chemical weapons or for the production of chemical weapons precursor9, it shall not export such chemicals and related equipment and technologies, whether included in the Control List or not. Article 17 Upon approval by the State Council, MOFTEC may, jointly with relevant departments of the State Council, temporarily decide to exercise export control on specific items and technologies other than those listed in the Control List in accordance with the provisions of these Measures. The export of the specific items and technologies set forth in the preceding paragraph shall be licensed in accordance with the provision of these Measures. Article 18 Those who export certain chemicals and related equipment and technologies without being licensed or export certain chemicals and related equipment and technologies beyond the scope of the export license without authorization23, shall be investigated for criminal liability in accordance with the provisions of the criminal law on the crime of smuggling24, the crime of illegal business operations, the crime of divulging25 State secrets or other crimes; if such acts are not serious enough for criminal punishment, by distinguishing different circumstances, they shall be punished in accordance with relevant provisions of the Customs Law, or be given a warning and fined for not less than twice but not more than five times the illegal income by MOFTEC, according to the circumstances; MOFTEC may concurrently26 revoke the licensing for their foreign trade operations. Article 19 Those who forge, alter, buy or sell, or obtain by fraud or other illegal means the license for the export of certain chemicals and related equipment and technologies shall be investigated for criminal liability in accordance with the provisions of the criminal law on the crime of illegal business operations or the crime of forging, altering, buying or selling official documents, certificates or seals of a State organ; if such acts are serious enough for punishment, they shall be punished in accordance with relevant provisions of the Customs Law, and MOFTEC may concurrently revoke the licensing for their foreign trade operations. Article 20 Where the State functionaries27 in charge of the control on the export of certain chemicals and related equipment and technologies abuse their powers, neglect their duties or extort28 or accept money or properties from others by taking advantage of their positions, they shall be investigated for criminal liability in accordance with the provisions of the criminal law on the crime of abuse of power, the crime of neglect of duties, the crime of accepting bribes29 and other crimes; if such acts are not serious enough for criminal punishment, they shall be given administrative sanctions according to law. Article 21 In light of actual situations, MOFTEC may, jointly with relevant departments of the State Council, amend30 the Control List.
