中国公民出国旅游管理办法

  《中国公民出国旅游管理办法》已经2001年12月12日国务院第50次常务会议通过,现予公布,自2002年7月1日起施行。

中国公民出国旅游管理办法

  第一条 为了规范旅行社组织中国公民出国旅游活动,保障出国旅游者和出国旅游经营者的合法权益,制定本办法。

  第二条 出国旅游的目的地国家,由国务院旅游行政部门会同国务院有关部门提出,报国务院批准后,由国务院旅游行政部门公布。

  任何单位和个人不得组织中国公民到国务院旅游行政部门公布的出国旅游的目的地国家以外的国家旅游;组织中国公民到国务院旅游行政部门公布的出国旅游的目的地国家以外的国家进行涉及体育活动、文化活动等临时性专项旅游的,须经国务院旅游行政部门批准。

  第三条 旅行社经营出国旅游业务,应当具备下列条件:

  (一)取得国际旅行社资格满1年;

  (二)经营入境旅游业务有突出业绩;

  (三)经营期间无重大违法行为和重大服务质量问题。

  第四条 申请经营出国旅游业务的旅行社,应当向省、自治区、直辖市旅游行政部门提出申请。省、自治区、直辖市旅游行政部门应当自受理申请之日起30个工作日内,依据本办法第三条规定的条件对申请审查完毕,经审查同意的,报国务院旅游行政部门批准;经审查不同意的,应当书面通知申请人并说明理由。

  国务院旅游行政部门批准旅行社经营出国旅游业务,应当符合旅游业发展规划及合理布局的要求。

  未经国务院旅游行政部门批准取得出国旅游业务经营资格的,任何单位和个人不得擅自经营或者以商务、考察、培训等方式变相经营出国旅游业务。

  第五条 国务院旅游行政部门应当将取得出国旅游业务经营资格的旅行社(以下简称组团社)名单予以公布,并通报国务院有关部门。

  第六条 国务院旅游行政部门根据上年度全国入境旅游的业绩、出国旅游目的地的增加情况和出国旅游的发展趋势,在每年的2月底以前确定本年度组织出国旅游的人数安排总量,并下达省、自治区、直辖市旅游行政部门。

  省、自治区、直辖市旅游行政部门根据本行政区域内各组团社上年度经营入境旅游的业绩、经营能力、服务质量,按照公平、公正、公开的原则,在每年的3月底以前核定各组团社本年度组织出国旅游的人数安排。

  国务院旅游行政部门应当对省、自治区、直辖市旅游行政部门核定组团社年度出国旅游人数安排及组团社组织公民出国旅游的情况进行监督。

  第七条 国务院旅游行政部门统一印制《中国公民出国旅游团队名单表》(以下简称《名单表》),在下达本年度出国旅游人数安排时编号发放给省、自治区、直辖市旅游行政部门,由省、自治区、直辖市旅游行政部门核发给组团社。

  组团社应当按照核定的出国旅游人数安排组织出国旅游团队,填写《名单表》。旅游者及领队首次出境或者再次出境,均应当填写在《名单表》中,经审核后的《名单表》不得增添人员。

  第八条 《名单表》一式四联,分为:出境边防检查专用联、入境边防检查专用联、旅游行政部门审验专用联、旅行社自留专用联。

  组团社应当按照有关规定,在旅游团队出境、入境时及旅游团队入境后,将《名单表》分别交有关部门查验、留存。

  出国旅游兑换外汇,由旅游者个人按照国家有关规定办理。

  第九条 旅游者持有有效普通护照的,可以直接到组团社办理出国旅游手续;没有有效普通护照的,应当依照《中华人民共和国公民出境入境管理法》的有关规定办理护照后再办理出国旅游手续。

  组团社应当为旅游者办理前往国签证等出境手续。

  第十条 组团社应当为旅游团队安排专职领队。

  领队应当经省、自治区、直辖市旅游行政部门考核合格,取得领队证。

  领队在带团时,应当佩戴领队证,并遵守本办法及国务院旅游行政部门的有关规定。

  第十一条 旅游团队应当从国家开放口岸整团出入境。

  旅游团队出入境时,应当接受边防检查站对护照、签证、《名单表》的查验。经国务院有关部门批准,旅游团队可以到旅游目的地国家按照该国有关规定办理签证或者免签证。

  旅游团队出境前已确定分团入境的,组团社应当事先向出入境边防检查总站或者省级公安边防部门备案。

  旅游团队出境后因不可抗力或者其他特殊原因确需分团入境的,领队应当及时通知组团社,组团社应当立即向有关出入境边防检查总站或者省级公安边防部门备案。

  第十二条 组团社应当维护旅游者的合法权益。

  组团社向旅游者提供的出国旅游服务信息必须真实可靠,不得作虚假宣传,报价不得低于成本。

  第十三条 组团社经营出国旅游业务,应当与旅游者订立书面旅游合同。

  旅游合同应当包括旅游起止时间、行程路线、价格、食宿、交通以及违约责任等内容。旅游合同由组团社和旅游者各持一份。

  第十四条 组团社应当按照旅游合同约定的条件,为旅游者提供服务。

  组团社应当保证所提供的服务符合保障旅游者人身、财产安全的要求;对可能危及旅游者人身安全的情况,应当向旅游者作出真实说明和明确警示,并采取有效措施,防止危害的发生。

  第十五条 组团社组织旅游者出国旅游,应当选择在目的地国家依法设立并具有良好信誉的旅行社(以下简称境外接待社),并与之订立书面合同后,方可委托其承担接待工作。

  第十六条 组团社及其旅游团队领队应当要求境外接待社按照约定的团队活动计划安排旅游活动,并要求其不得组织旅游者参与涉及色情、赌博、毒品内容的活动或者危险性活动,不得擅自改变行程、减少旅游项目,不得强迫或者变相强迫旅游者参加额外付费项目。

  境外接待社违反组团社及其旅游团队领队根据前款规定提出的要求时,组团社及其旅游团队领队应当予以制止。

  第十七条 旅游团队领队应当向旅游者介绍旅游目的地国家的相关法律、风俗习惯以及其他有关注意事项,并尊重旅游者的人格尊严、宗教信仰、民族风俗和生活习惯。

  第十八条 旅游团队领队在带领旅游者旅行、游览过程中,应当就可能危及旅游者人身安全的情况,向旅游者作出真实说明和明确警示,并按照组团社的要求采取有效措施,防止危害的发生。

  第十九条 旅游团队在境外遇到特殊困难和安全问题时,领队应当及时向组团社和中国驻所在国家使领馆报告;组团社应当及时向旅游行政部门和公安机关报告。

  第二十条 旅游团队领队不得与境外接待社、导游及为旅游者提供商品或者服务的其他经营者串通欺骗、胁迫旅游者消费,不得向境外接待社、导游及其他为旅游者提供商品或者服务的经营者索要回扣、提成或者收受其财物。

  第二十一条 旅游者应当遵守旅游目的地国家的法律,尊重当地的风俗习惯,并服从旅游团队领队的统一管理。

  第二十二条 严禁旅游者在境外滞留不归。

  旅游者在境外滞留不归的,旅游团队领队应当及时向组团社和中国驻所在国家使领馆报告,组团社应当及时向公安机关和旅游行政部门报告。有关部门处理有关事项时,组团社有义务予以协助。

  第二十三条 旅游者对组团社或者旅游团队领队违反本办法规定的行为,有权向旅游行政部门投诉。

  第二十四条 因组团社或者其委托的境外接待社违约,使旅游者合法权益受到损害的,组团社应当依法对旅游者承担赔偿责任。

  第二十五条 组团社有下列情形之一的,旅游行政部门可以暂停其经营出国旅游业务;情节严重的,取消其出国旅游业务经营资格:

  (一)入境旅游业绩下降的;

  (二)因自身原因,在1年内未能正常开展出国旅游业务的;

  (三)因出国旅游服务质量问题被投诉并经查实的;

  (四)有逃汇、非法套汇行为的;

  (五)以旅游名义弄虚作假,骗取护照、签证等出入境证件或者送他人出境的;

  (六)国务院旅游行政部门认定的影响中国公民出国旅游秩序的其他行为。

  第二十六条 任何单位和个人违反本办法第四条的规定,未经批准擅自经营或者以商务、考察、培训等方式变相经营出国旅游业务的,由旅游行政部门责令停止非法经营,没收违法所得,并处违法所得2倍以上5倍以下的罚款。

  第二十七条 组团社违反本办法第十条的规定,不为旅游团队安排专职领队的,由旅游行政部门责令改正,并处5000元以上2万元以下的罚款,可以暂停其出国旅游业务经营资格;多次不安排专职领队的,并取消其出国旅游业务经营资格。

  第二十八条 组团社违反本办法第十二条的规定,向旅游者提供虚假服务信息或者低于成本报价的,由工商行政管理部门依照《中华人民共和国消费者权益保护法》、《中华人民共和国反不正当竞争法》的有关规定给予处罚。

  第二十九条 组团社或者旅游团队领队违反本办法第十四条第二款、第十八条的规定,对可能危及人身安全的情况未向旅游者作出真实说明和明确警示,或者未采取防止危害发生的措施的,由旅游行政部门责令改正,给予警告;情节严重的,对组团社暂停其出国旅游业务经营资格,并处5000元以上2万元以下的罚款,对旅游团队领队可以暂扣直至吊销其领队证;造成人身伤亡事故的,依法追究刑事责任,并承担赔偿责任。

  第三十条 组团社或者旅游团队领队违反本办法第十六条的规定,未要求境外接待社不得组织旅游者参与涉及色情、赌博、毒品内容的活动或者危险性活动,未要求其不得擅自改变行程、减少旅游项目、强迫或者变相强迫旅游者参加额外付费项目,或者在境外接待社违反前述要求时未制止的,由旅游行政部门对组团社处组织该旅游团队所收取费用2倍以上5倍以下的罚款,并暂停其出国旅游业务经营资格,对旅游团队领队暂扣其领队证;造成恶劣影响的,对组团社取消其出国旅游业务经营资格,对旅游团队领队吊销其领队证。

  第三十一条 旅游团队领队违反本办法第二十条的规定,与境外接待社、导游及为旅游者提供商品或者服务的其他经营者串通欺骗、胁迫旅游者消费或者向境外接待社、导游和其他为旅游者提供商品或者服务的经营者索要回扣、提成或者收受其财物的,由旅游行政部门责令改正,没收索要的回扣、提成或者收受的财物,并处索要的回扣、提成或者收受的财物价值2倍以上5倍以下的罚款;情节严重的,并吊销其领队证。

  第三十二条 违反本办法第二十二条的规定,旅游者在境外滞留不归,旅游团队领队不及时向组团社和中国驻所在国家使领馆报告,或者组团社不及时向有关部门报告的,由旅游行政部门给予警告,对旅游团队领队可以暂扣其领队证,对组团社可以暂停其出国旅游业务经营资格。

  旅游者因滞留不归被遣返回国的,由公安机关吊销其护照。

  第三十三条 本办法自2002年7月1日起施行。国务院1997年3月17日批准,国家旅游局、公安部1997年7月1日发布的《中国公民自费出国旅游管理暂行办法》同时废止。

Measures for Administration of Outbound Tours by Chinese Citizens

  Adopted at the 50th Executive Meeting of the State Council on December 12, 2001, promulgated1 by Decree No. 354 of the State Council of the People's Republic of China on May 27, 2002, and effective as of July 1, 2002)

  Article 1These Measures are formulated2 for the purposes of regulating Chinese citizens' outbound tours organized by travel agencies and safeguarding the lawful3 rights and interests of the tourists and operators of outbound tours.

  Article 2The countries with approved destination status shall be proposed by the tourism administration department of the State Council jointly4 with the relevant departments of the State Council and published by the tourism administration department of the State Council after submission5 to and approval by the State Council.

  No unit or individual may organize Chinese citizens for tours to countries other than the countries with approved destination status published by the tourism administration department of the State Council; organizing Chinese citizens for temporary tours involving sports, culture or other specialized6 activities to countries other than the countries with approved destination status published by the tourism administration department of the State Council shall be subject to the approval of the tourism administration department of the State Council.

  Article 3A travel agency that is to operate the business of outbound tours shall meet the following requirements:

  (1) one full year has passed since it obtained the qualifications as an international travel agency;

  (2) having prominent performance in operating the business of inbound tours;

  (3) having no record of serious law-breaking acts and major problems in service quality in its operation.

  Article 4A travel agency that applies for operating the business of outbound tours shall submit an application to the tourism administration department of the province, autonomous7 region or municipality directly under the Central Government, which shall, within 30 working days from the date of accepting the application, finish the examination thereof in accordance with the requirements set forth8 in Article 3 of these Measures. Upon examination, if the application is approved, it shall be submitted to the tourism administration department of the State Council for approval; if the application is denied, the applicant9 shall be informed in writing with the reasons therefor stated.

  The tourism administration department of the State Council shall approve travel agencies operating the business of outbound tours on the basis of tourism development plans and the need for rational distribution.

  Without approval from the tourism administration department of the State Council, no unit or individual may operate the business of outbound tours or conduct such operation under the disguises such as business, study or training trips.

  Article 5The tourism administration department of the State Council shall publish the name list of the travel agencies that have obtained the qualifications for operating the business of outbound tours (hereinafter referred to as authorized10 travel agencies) and circulate such list among the relevant departments of the State Council.

  Article 6The tourism administration department of the State Council shall, on the basis of the nationwide performance of inbound tourism in the previous year, the increase in the number of destination countries and the trend of outbound tours, determine by the end of February each year the annual total quotas11 of outbound tourists, and distribute quotas to the tourism administration departments of the provinces, autonomous regions and municipalities directly under the Central Government.

  The tourism administration departments of the provinces, autonomous regions and municipalities directly under the Central Government shall, on the basis of the performance in operating inbound tours in the previous year, operation capacity and service quality of each authorized travel agency in their respective administrative12 areas, determine by the end of March each year the annual quotas of outbound tourists to be distributed to each authorized travel agency in a fair, just and open way.

  The tourism administration department of the State Council shall supervise the determination of the annual quotas of outbound tourists to be distributed to authorized travel agencies by the tourism administration departments of the provinces, autonomous regions and municipalities directly under the Central Government, as well as the organizing of outbound tours by authorized travel agencies.

  Article 7The tourism administration department of the State Council shall uniformly print the Roster13 of Outbound Tourist Groups of Chinese Citizens (hereinafter referred to as the roster), and, when distributing the annual quotas of outbound tourists, serially14 number such rosters15 and distribute them to the tourism administration departments of the provinces, autonomous regions and municipalities directly under the Central Government, which shall further distribute such rosters to the authorized travel agencies.

  Authorized travel agencies shall organize tourist groups to foreign countries in accordance with the quotas of outbound tourists distributed to them and fill out the roster. Both the names of the tourists and the group leader shall be on the roster, no matter whether it is the first time of his exit or not. No person may be added to the roster after it has been verified.

  Article 8The roster shall be in quadruplicate. One copy shall be for the exit frontier inspection16, one for the entry frontier inspection, one for examination by the tourism administration department and the last shall be kept by the travel agency.

  The authorized travel agency shall, in accordance with the relevant provisions, submit the roster to the relevant departments for examination and record when the tourist group leaves or enters the Chinese territory and after such tourist group re-enters the Chinese territory.

  Foreign currencies needed for outbound tours shall be handled by the tourists themselves in accordance with the relevant provisions of the State.

  Article 9Tourists holding valid17 common passports may go through the formalities for their outbound tours directly with the authorized travel agencies; those without valid common passports shall obtain the passports in accordance with the relevant provisions of the Law of the People's Republic of China on the Control of Exit and Entry of Citizens before going through the formalities for their outbound tours.

  Authorized travel agencies shall go through the exit formalities for their tourists, including their visas for entering the destination country.

  Article 10Authorized travel agencies shall appoint a full-time18 leader for each tourist group.

  Group leaders shall pass the examination by the tourism administration department of the province, autonomous region or municipality directly under the Central Government, and obtain the tourist group leader cards.

  Group leaders shall wear their tourist group leader cards while leading groups, and comply with these Measures and other relevant provisions of the tourism administration department of the State Council.

  Article 11Tourist groups shall leave and enter the Chinese territory as a whole at the open ports designated by the State.

  Tourist groups shall, when leaving or entering the Chinese territory, be subject to the inspection of their passports, visas and the roster by the frontier inspection stations. Upon approval of the relevant departments of the State Council, tourist groups may go through the formalities for visas or visa abolition19 at the destination country in accordance with the relevant provisions of that country.

  Where it is decided20 before departure that the group members will re-enter the Chinese territory in several batches21, the authorized travel agency shall report the situation for the record in advance to the general exit and entry frontier inspection station or the provincial22 public security and frontier department.

  Where a tourist group, after leaving the Chinese territory, needs to re-enter the Chinese territory in several batches due to force majeure or other special reasons, the group leader shall notify the authorized travel agency promptly23 and the authorized travel agency shall report forthwith the situation for the record to the general exit and entry frontier inspection station or the provincial public security and frontier department.

  Article 12Authorized travel agencies shall safeguard the lawful rights and interests of tourists.

  The information on outbound tour services provided by authorized travel agencies must be authentic24 and reliable and no false publicity25 shall be conducted. The price offered shall not be lower than the cost.

  Article 13In operating the business of outbound tours, authorized travel agencies shall conclude written tour contracts with tourists.

  The tour contract shall specify26 the starting and finishing time of the tour, itinerary27, price, accommodations, transportation and liability for breach28 of contract. The tour contract shall be in duplicate, with one copy kept by the authorized travel agency and the other by the tourist.

  Article 14Authorized travel agencies shall provide services to tourists in accordance with the conditions stipulated29 in the tour contracts.

  Authorized travel agencies shall guarantee that the services they provide comply with the requirements for the tourists' personal and property safety; in case of potential danger to the tourists' personal safety, they shall make true disclosure to the tourists and give explicit30 warnings therefor, and take effective measures to prevent the occurrence of any danger.

  Article 15In organizing outbound tours, authorized travel agencies shall choose reputable travel agencies legally established in the destination countries (hereinafter referred to as local land operators), and conclude a written contract with them before entrusting31 them with the land operation.

  Article 16Authorized travel agencies and leaders of the tourist groups shall require the local land operators to arrange the tours in accordance with the agreed plan for group activities, not to organize tourists to take part in any pornographic, gambling33, drug-taking or dangerous activities, not to change the itinerary or reduce tour items without consent, and not to force or force under disguises tourists to take part in items with additional charges.

  Where the local land operators violate the requirements posted by the authorized travel agencies and leaders of the tourist groups in accordance with the provisions of the preceding paragraph, the authorized travel agencies or leaders shall stop such violations34.

  Article 17Tourist group leaders shall explain to tourists the relevant laws of the destination countries, their customs and other things needing attention, and respect tourists' personal dignity, religious beliefs, customs and living habits of ethnic36 groups.

  Article 18When leading tourists in journeys or sightseeing, tourist group leaders shall make true disclosure to the tourists of the potential danger to the tourists' personal safety and give explicit warnings therefor, and take effective measures as required by the authorized travel agency to prevent the occurrence of any danger.

  Article 19Where a tourist group encounters special difficulties or security problems outside the territory, the tourist group leader shall report the situation promptly to the authorized travel agency and the Chinese embassy or consulate37 in the destination country. The authorized travel agency shall promptly report the situation to the tourism administration department and the public security organ.

  Article 20Tourist group leaders shall not collaborate38 with local land operators, tour guides, or other commodity or service providers in order to cheat tourists or force them to consume, and shall not ask for rebates39 or deductions40 or accept money or property from local land operators, tour guides, or other commodity or service providers.

  Article 21Tourists shall comply with the laws of the destination countries and respect the local customs and habits and be subject to the uniform management of the tourist group leader.

  Article 22Tourists are strictly42 forbidden to overstay abroad.

  For those who overstay abroad, the tourist group leader shall report the situation promptly to the authorized travel agency and the Chinese embassy or consulate in the destination country, and the authorized travel agency shall promptly make a report thereon to the public security organ and the tourism administration department. When the relevant department handles such matters, the authorized travel agency has the duty to give cooperation.

  Article 23Tourists have the right to complain to the tourism administration department against any act violating the provisions of these Measures by the authorized travel agencies or tourist group leaders.

  Article 24Where tourists' lawful rights and interests suffer damage due to breach of the contract by the authorized travel agencies or by the local land operators they entrust32, the authorized travel agencies shall assume the liabilities of compensation to the tourists according to law.

  Article 25Where an authorized travel agency comes under any of the following circumstances, the tourism administration department may suspend its outbound tour business; if the circumstances are serious, the tourism administration department shall revoke43 its qualifications for operating the business of outbound tours:

  (1) having a decrease in its inbound tour business;

  (2) failing to normally carry out outbound tour business within one year due to its own problems;

  (3) being complained against for its poor outbound tour service and the complaints are proved to be true after investigation44;

  (4) evading45 or illegally purchasing foreign exchange;

  (5) resorting to deception46 or trickery in the name of tourism in order to obtain passports, visas or other exit or entry documents or help other persons to leave the Chinese territory;

  (6) other acts which are confirmed by the tourism administration department of the State Council as affecting the order of Chinese citizens' outbound tours.

  Article 26Where any unit or individual, in violation35 of the provisions of Article 4 of these Measures, operates the business of outbound tours without approval or conducts such operations under the disguises such as business, study or training trips, the tourism administration department shall order the violator to stop such illegal operations, confiscate47 the illegal income and concurrently48 impose a fine of not less than two times but not more than five times the illegal income.

  Article 27Where any authorized travel agency, in violation of the provisions of Article 10 of these Measures, fails to appoint a full-time leader for the tourist group, the tourism administration department shall order it to make corrections and concurrently impose a fine of not less than 5,000 yuan but not more than 20,000 yuan, and may suspend its qualifications for operating the business of outbound tours; if it fails to appoint a full-time group leader many times, its qualifications for operating the business of outbound tours shall be revoked49.

  Article 28Where any authorized travel agency, in violation of the provisions of Article 12 of these Measures, provides false service information to tourists or offers a price lower than the cost, the administrative department for industry and commerce shall punish it in accordance with the relevant provisions of the Law of the People's Republic of China on the Protection of the Rights and Interests of Consumers or the Law of the People's Republic of China on Countering Unfair Competition.

  Article 29Where any authorized travel agency or tourist group leader, in violation of the provisions of the second paragraph of Article 14 or Article 18 of these Measures, fails to make true disclosure to the tourists of the potential danger to the tourists' personal safety and give explicit warnings therefor, or fails to take measures to prevent the occurrence of such dangers, the tourism administration department shall order the violator to make corrections and give it a warning; if the circumstances are serious, the qualifications of the authorized travel agency for operating the business of outbound tours shall be suspended and a fine of not less than 5,000 yuan but not more than 20,000 yuan shall be concurrently imposed, and the card of the tourist group leader may be suspended or even revoked; if casualties are caused, criminal responsibility shall be investigated according to law, and liability of compensation shall be assumed.

  Article 30Where any authorized travel agency or tourist group leader, in violation of the provisions of Article 16 of these Measures, fails to require the local land operator not to organize tourists to take part in any pornographic, gambling, drug-taking or other dangerous activities, not to change the itinerary or reduce tourist items, and not to force or force under disguises tourists to take part in items with additional charges, or fails to stop the local land operator violating the above-mentioned requirements, the tourism administration department shall impose on the authorized travel agency a fine of not less than two times but not more than five times the fee it has collected for organizing the tourist group, suspend its qualifications for operating the business of outbound tours, and suspend the tourist group leader's card; if such case gives rise to bad influences, the qualifications of the authorized travel agency for operating the business of outbound tours and the tourists group leader's card shall be revoked.

  Article 31Where any group leader, in violation of the provisions of Article 20 of these Measures, collaborates50 with local land operators, tour guides or other commodity or service providers in order to cheat or force tourists to consume, or asks for rebates or deductions or accepts money or property from local land operators, tour guides or other commodity or service providers, the tourism administration department shall order him to make corrections, confiscate the said rebates, deductions, money or property, and concurrently impose a fine of not less than two times but not more than five times the value of the said rebates, deduction41, money or property; if the circumstances are serious, the tourist group leader's card shall be revoked.

  Article 32Where, in violation of the provisions of Article 22 of these Measures, any tourist overstay abroad and the tourist group leader fails to report such situation promptly to the authorized travel agency and the Chinese embassy or consulate in the destination country, or the authorized travel agency fails to report such situation promptly to the relevant department, the tourism administration department shall give a warning, and may suspend the tourist group leader's card and suspend the authorized travel agency's qualifications for operating the business of outbound tours.
