上海市人民政府关于印发《上海市粮食收购资格暂行规定》的通知

各区、县人民政府，市政府各委、办、局：

　　现将《上海市粮食收购资格暂行规定》印发给你们，请按照执行。

上海市粮食收购资格暂行规定

　　为了规范粮食收购市场秩序，保护粮食生产者的积极性，促进粮食生产，维护粮食经营者的合法权益，根据《粮食流通管理条例》（国务院令第407号）的有关规定，本市从事粮食收购活动的经营者应当具备下列条件：

　　一、经营资金筹措能力

　　（一）法人和其他经济组织能够筹措经营资金50万元以上；

　　（二）个体工商户能够筹措经营资金3万元以上。

　　二、必要的粮食仓储设施

　　法人、其他经济组织和个体工商户拥有或者通过租借使用面积300平方米以上的粮食仓库，并符合下列条件：

　　（一）达到防台、防汛、消防安全等基本要求；

　　（二）具有合适的电源、水源、交通、通信等外部协作条件；

　　（三）离开污染源及易燃、易爆场所在500米以外。

　　三、相应的粮食质量检验和保管能力

　　（一）收购粮食所用的计量器具符合法律、法规、规章的要求；

　　（二）配备扦样器、水分快速测定仪、实验砻谷机、容重器、谷物选筛、天平、测温器等粮食检验、保管常规仪器，能够进行粮食定等、测水、检验杂质等粮食收购质量指标的检验；

　　（三）法人和其他经济组织至少有经过专业培训的粮食检验人员和保管人员各1名，个体工商户至少有1名经过专业培训的人员负责粮食检验和保管工作。

Interim¹ Provisions of Shanghai Municipality on the Qualifications for Grain Purchase

　　With a view to normalizing the order of the grain purchase market, protecting the enthusiasm of grain producers, promoting the production of grain, safeguarding the legitimate² rights and interests of grain dealers⁴, and according to the relevant provisions of the "Regulations on the Administration of Grain Circulation" （Decree No.407 of the State Council）, any dealer³ who is engaged in the activity of grain purchase in this Municipality shall fulfil the following requirements:

　　Ⅰ. Ability to Raise the Operating Funds

　　1. Legal entities⁵ and other organizations are able to raise the operating funds amounting to not less than 500,000 yuan.

　　2. Individual industrialists⁶ and merchants are able to raise the operating funds amounting to not less than 30,000 yuan.

　　Ⅱ. Necessary facilities for grain storage

　　Legal entities, other organizations and Individual industrialists and merchants shall have or use by renting the granary with an area of not less than 300 square meters, which shall meet the following requirements:

　　1. Meeting the basic requirements of defending against typhoon and flood and protecting safety from fire accidents.

　　2. Having the proper externally conditions for coordination⁷ on power supply, water supply, transportation and communication.

　　3. Being located at least 500 meters away from the pollutant⁸ source and the places that may easily cause fire or explosion.

　　Ⅲ. Corresponding capability⁹ of Quality Testing and Safekeeping for Grain

　　1. The metrological apparatuses¹⁰ used in grain purchase shall meet the requirements of laws, rules and regulations.

　　2. Being equipped with grain testing and safekeeping apparatuses such as probe, moisture content tester, testing husker, test weight tester, sieve¹¹, scale, and grain temperature detector¹², and having the capability of examining the quality index for grain purchase, such as grade setting, moisture analyzing¹³, impurities¹⁴ testing.

　　3. Legal entitles and other economic organizations shall have at least one each of grain examiner and grain safekeeper who have received professional training, and individual industrialists and merchants shall have at least one professionally trained person to take charge of the examination and safekeeping of grain.
