(Adopted at the 14th Meeting of the Standing1 Committee of the Ninth National People's Congress on March 1, 2000) For the purpose of fulfiling the functions invested by the Constitution, tightening2 supervision3 over economic work and promoting the sustainable, fast and sound development of the national economy, the National People's Congress (NPC) and its Standing Committee, on the basis of the Constitution and the relevant laws. Has reviewed its experience in practice over the years and adopted the following decisions: 1. The Standing Committee of the NPC shall, in accordance with law, exercise the function and power of supervision over the economic work executed by the State Council. 2. The draft annual plans, five-year plans and long-term programmes prepared by the State Council for national economic and social development shall, one month prior to the convocation of the session of the NPC, submit them to the Standing Committee of the NPC. 3. During the session of the NPC, the Finance and Economic Committee shall, on the basis of the proposals offered by the delegations4 and the relevant special committees, examine the draft plans and the report on the plans, and submit a report on the result of its examination, which, after being deliberated on and adopted by the Presidium, shall be printed and distributed t the deputies. 4. When examining the draft annual plan and the report on the plan, the Finance and Economic Committee shall pay attention to the following main points. They are: the guidelines for adopting the plans are in conformity5 with the Five-Year Plan and the Long-term Program for National Economic and Social Development approved by the NPC; the main goals and quotas6 are in conformity with the requirements for sustained and stable development of the national economy; and the chief measures adopted are in conformity with the requirements for enhanced macro- control, optimized7 economic structure, better plans for the key construction projects of the State, improved living standards of the People, redoubled efforts for creating more job opportunities, improved social security and sustainable development. 5. With regard to the important construction projects of the State which involve broad fields of endeavours, have a far-reaching significance and need huge amounts of investment, the State Council may put forward proposals to the NPC or its Standing Committee for examination and decision. 6. Where, when the economy moves forward, partial readjustments must to be made to the annual plan, the five-year plan or the long-term programme which have been approved by the NPC, the State Council shall submit proposals to the Standing Committee for examination and approval.Except for special cases, the State Committee shall, one month prior to the meeting held by the Standing Committee, submit the proposals regarding the planned readjustments to the Standing Committee. The State Council shall, in August, submit to the Standing Committee of the NPC a report on how the plans are implemented8 in the first half of the year. Where major changes occur when the economy move forward, the State Council shall report such changes to the Standing Committee of the NPC and give explanations. The Standing Committee of the NPC may, where necessary, listen to and examine the reports on special subjects made by the State Council regarding economic work. The Standing Committee of the NPC shall supervise the implementation9 of the plans for national economic and social development and, when necessary, may, by way of supervision, listen to the report made by the State Council on its work regarding the planned key construction projects of the State. 7. Conclusion and abrogation10 of any economic treaty or agreement with any foreign country or international organization, which, in accordance with the provisions in the Law of the People's Republic of China on the Procedure of the Conclusion of Treaties, are subject to decision and State Council to the Standing Committee of the NPC for examination and decision. 8. On the authorization11 of the Council of Chairmen, the special committees concerned may convene12 plenary meetings to hear reports on special subjects made by the relevant departments under the State Council.Such reports be arranged by the State Council in a unified13 way. The Finance and Economic Committee shall convene plenary meetings, prior to the 15th of April, July and October, to hear reports made by the relevant departments under the State Council on the development of the national economy for the first season, the first half and the first three seasons of the year and analyse and study these reports. 9. For the meetings held by the Standing Committee of the NPC to deliberate on and discuss the matters listed in this Decision, the State Council shall, when requested, provide the relevant information, materials and explanations in time and send leading members of the State Council or of the relevant departments to attend the meetings, hear comments and suggestions and answer questions. For the plenary meetings held by the special committees to deliberate on and discuss the matters listed in this Decision, the relevant departments under the State Council shall, when requested, provide the relevant information, materials and explanations in tie and send leading members of the State Council or of the relevant departments to attend the meeting, hear comments and suggestions and answer questions. 10. The special committees shall report to the Council of Chairmen the comments and suggestions they put forward at their plenary meetings after hearing the reports made by the relevant departments under the State Council, the Council of Chairmen shall deliberate on the comments and suggestions and decide to refer them to the State Council and the relevant departments under it for study and handling, and the special committees shall report the result to the Standing Committee of the NPC. 11.
