Nov.3 - Huawei, China's biggest maker1 of telecommunications network equipment, is encouraging more than 7,000 of its employees who have been working for the company for at least eight years to "retire" and sign new short-term contracts. This large-scale reshuffling is expected to be completed by Jan. 1, 2008, when the revised Law on Employment Contracts takes effect in China, Nanfang Daily reported.
Sources with the company revealed that the group of veteran employees who face "retirement2" will be offered the chance to stay on by signing new contracts valid3 for one to three years. The company also promised to compensate4 those who volunteer to leave. The compensation total may amount up to nearly one billion yuan ($134 million), which has sent shockwaves since its announcement.
The Shenzhen-based telecom company has taken this bold move in response to an article written in the new labor5 contract law. The law stipulates6 that an employer and an employee may conclude an open-ended contract upon reaching a negotiated consensus7 if the employee has been working for the employer for a consecutive8 period of at least 10 years.
The group of telecom elites9 who face "retirement" still have two years ahead of them before reaching the 10-year employment mark, which may make them eligible10 for open-ended employment contracts under the new labor contract law, and thus permanent employees of the company.
Some human resource experts say Huawei is taking this measure in order to cut down on the number of open-ended employment contracts with employees.
The revised labor law highlights employees' rights and threatens to impact the competitiveness of certain enterprises. Some people expressed their understanding of recent corporate11 behavior, noting that certain companies may take protective measures so as to keep operating costs low and maintain a competitive edge.
Yet there are also some speaking out against such practices, saying it is both irresponsible to have employees voluntarily resign short-term contracts and possibly damaging to a business's reputation.
Insiders worry that many other domestic companies may follow Huawei's example before the new law takes effect on January 1.
